LOCATION

The site is located with in the village of Llangurig, Powys, approximately 5 miles south-west of Llanidloes, 19 miles from Newtown and 52 miles from Shrewsbury. The market town of Rhayader is 10 miles to the south and the university town of Aberystwyth is 25 miles to the west. There is a railway station in Caersws (13 miles) offering a link to Shrewsbury in 50 minutes. A location plan is attached to the rear of these sales details.

DESCRIPTION

The site extends to approximately 0.73 acre (0.295 ha) and is currently used as a paddock. Access is off the public highway at the western end of the site. The site also has frontage on to the A44 at the eastern end of the site. The site is green field and is generally level.

PLANNING

The site lies within the jurisdiction of Powys County Council. Full planning permission was granted by the previous Montgomeryshire District Council in 1994 for the “ erection of 10 dwellinghouses and formation of vehicular access ” under application reference M23449.

This planning permission was accompanied by a Section 106 Agreement dated 16th May 1994 and requires that t wo of the houses have a local occupancy restriction.

The planning permission was subsequently renewed on 17th December 1998 under application reference M98842 with the following description:

“Erection of 10 dwellinghouses and formation of vehicular access (renewal of permission M23449) at Land adjoining Penybont Farm, Maes Curig, Llangurig”

Copies of the planning permission and Section 106 are available from the selling agents. Our client commenced construction of foundations to plots 3 and 4 in September 2003, works which were registered under Powys County Council Building Control reference PM/JPF/2003/0360.

The first section of the access road (capable of being upgraded to adoptable standards) was constructed in 2004 at a total cost of £25,532 under Powys County Council Consent Reference V0678 dated 13th December 2004.

The above works mean that the 1998 planning permission is extant i.e. “live”.

Plots 1 and 2 at the western end of the site were subsequently sold and an attractive “Border Oak” style house was constructed thereon under a completely independent (subsequent) planning consent. The remainder of the site which we are instructed to sell can accommodate eight of the original 10 consented houses.

HIGHWAYS DEPOSIT

Our client was required to lodge a deposit of £12,462 with Powys County Council in 2004 under the Advanced Payments Code (APC), as security for the construction of the development access road to an adoptable standard. Since 2004 our client has financed the construction of the entrance splay and the first section of the access road. Our client will retain the benefit of the original APC deposit and all accrued interest. The purchaser (developer) will be required with effect from completion to establish substitute arrangements to the satisfaction of Powys County Council.

TENURE

The freehold interest is for sale with vacant possession upon completion.

GUIDE PRICE

We are seeking £170,000. VAT will not be charged.

LEGAL COSTS
